Tips for a child custody case

A parent in El Paso who is getting a divorce may also be heading into a child custody battle. If possible, it is best to avoid this. The parent might be unhappy with the judge's decision, and a compromise in which both parents agree to share custody might be better. However, if a court case is unavoidable, there are steps a parent can take that may increase the likelihood that they will win custody.

The parent should research child custody and may want to hire an attorney. During the child custody hearing, the parent should dress professionally and conduct themselves politely because these will all influence the judge's opinion of the parent. A judge may also look more favorably on a parent who can demonstrate that they are able to compromise with the other parent. A parent might also be allowed to bring in documentation that supports their side.

The court will make a decision that it believes is in the best interests of the child. However, the parent who does not get primary custody may still have extensive visitation rights. Parents might also want to create a parenting plan that covers their expectations for raising the child.

Negotiating child custody and visitation may be difficult, but before going to court, parents may want to work with a mediator to see if they can resolve their issues. The advantage of a mediator over litigation is that mediation is focused on finding a solution that suits all parties instead of one in which there is a winner and loser. Mediation may also help parents develop conflict resolution skills that they can continue to use over the years of co-parenting. The parenting agreement might also include a plan to go back to mediation if any other major issues arise.
